Intoxication Manslaughter

Under Texas law, a person commits intoxication manslaughter if he or she operates a motor vehicle, aircraft, watercraft, or amusement ride in a public place while intoxicated, and causes the death of another by accident or mistake because of being intoxicated.

Possession of a Controlled Substance

Substances such as cocaine, heroin, and methamphetamine are obviously illegal. Possessing these substances if you don’t have a valid prescription is a crime. If you are found to have a controlled substance in your possession and do not have a valid prescription, you are charged with possession of a controlled substance.

Possession of Marijuana

Marijuana is NOT LEGAL in Texas. Despite what you might have heard, possession of marijuana is not legal in Texas. This applies to not only marijuana itself, but also to any substance that contains marijuana. Possession of marijuana in an amount less than 2 ounces is a Class B Misdemeanor. However, possession of any other substance that contains THC, is a Felony in Texas. The level felony depends on the total weight of the substance possessed.
